WINTER WONDERLAND WALK TERMS & CONDITIONS

PLEASE READ AND UNDERSTAND THESE TERMS & CONDITIONS OF BOOKING. By booking for the Winter Wonderland Walk (the ‘Event’), the booker (the ‘Purchaser’) agrees that all visiting guests ('Ticketholders') agree to and will abide by the following terms and conditions, set by Springfields Designer Outlet (the ‘Organiser’).

ORDERING TICKETS

1) Before you finalise your booking, the Purchaser must read all information that applies to the Event. If you or any member of your party has particular requirements, please raise these prior to booking, and the Organiser will endeavour to address your query. There can be no guarantee that requirements can be met if notified at the event.

2) An order for tickets is not complete until accepted by the Organiser. The Organiser will try to ensure all prices are accurate, but errors may occur. If the Organiser discovers an error in the price of tickets you have ordered, we will inform you as soon as possible, and we may either cancel the order (in which case you will be refunded the ticket price and any booking, transaction or supplementary fees you have paid) or give you the option of confirming your order at the correct price.

3) Tickets are personal revocable licenses and shall at all times remain the property of the Organiser and subject to these Terms and Conditions. You may not resell or transfer a ticket for commercial gain. If a ticket is re-sold, transferred or advertised for profit or commercial gain or used for competitions, promotions or hospitality packages by anyone other than the organiser, or an authorised sub-agent, it will be void and you will be refused entry to, or ejected from, the Venue without refund. Should you resell a ticket to a third party, you may find that the third party brings a legal claim against you for selling a ticket which does not permit access to the Event. The organiser reserves the right to cancel any ticket booking which it reasonably believes to have been made with a view to reselling tickets or where the ticket has been purchased using fraudulent means, including credit card fraud.

4) Tickets may be restricted to a maximum number per Purchaser, per credit card or per household. These restrictions will be notified to you before you make your booking. The Organiser reserves the right to cancel tickets purchased in excess of this number without prior notification to you of such cancellation.

5) Promotional tickets (such as discounted or ‘Early Bird’ tickets) may be made available by the Organiser to Purchasers for a limited time at a rate lower than the standard price. Once this time period/allocated quantity ends, the standard price will apply. Promotional tickets can be made unavailable for purchase at any time at the organiser's discretion.

6) Purchasers must check tickets (including session dates/times) carefully as errors cannot be rectified following purchase.

7) Tickets are not issued by the Organiser on a sale or return basis. Refunds will not be made by the Organiser on returned tickets unless otherwise provided under the Terms and Conditions.

8) The Organiser is not responsible for any ticket that is lost, stolen or destroyed. The Purchaser is solely responsible for the safety of their ticket(s).

If the Purchaser does not receive their ticket(s) after purchase, they must notify the Organiser at the earliest opportunity by an authorised contact method found on the Organiser’s website, no later than 48 hours prior to the event commencing.

9) This is a pre-booked Event and tickets can only be booked online. Tickets are limited and cannot be reserved without purchase.

EVENT ARRIVALS

10) The Purchaser agrees that all Ticketholders will arrive before, or at, the time stated on their booking. The Organiser has the right to refuse entry after the scheduled entry time. Ticketholders must anticipate there will be a queue prior to entry and make accommodations for this to ensure entry.

11) The Event will close 45 minutes after the last advertised time slot on each day. Ticketholders must vacate the Event by this time.

12) Entry is strictly permitted only for the booked timeslot for each Ticketholder's ticket.

13) Tickets will not be refunded once they have been used to gain entry to the Event, or where you are given the option to attend a postponed Event on an alternative date.

14) All Ticketholders aged under 16 (or in possession of a child’s ticket) must be accompanied by at least one adult Ticketholder.

15) Access to each designated Event area within the Venue is subject to capacity, and the Organiser accepts no liability and will not offer any ticket refunds if Ticketholders are unable to access an area due to that area being at maximum capacity. Ticketholders may be required to queue, so please arrive early to avoid disappointment.

EVENT SAFETY

16) The Purchaser and Ticketholders must be aware that lighting, by the very nature of the experience, including prolonged lighting, flashing lights, lasers and strobe lighting, may be in use during the Event. The Organiser strongly advises Ticketholders with any medical condition(s) aggravated by these types of lighting to NOT BOOK OR VISIT the Winter Wonderland Walk.

17) If a Ticketholder feels unwell or has any viral symptoms or infectious diseases, please stay at home and do not attend. In accordance with the Event refund policy, no refunds will be available in this instance, as the ticket will remain valid for use.

18) All Ticketholders must read and adhere to all instructions and advice given by Event staff, on-site signage and these terms & conditions.

19) All children and vulnerable adults must be closely supervised at all times by their parents/guardians/carers.

20) All Ticketholders must refrain from touching any lights/electrical installations.

21) The Organiser reminds all visitors that this Event takes place in the winter, after sunset. Areas other than the clearly defined route may have potential trip hazards and/or risks to health and safety. These may be difficult to see during the Event. To ensure the safety of all, Ticketholders must stay on the clearly defined route and exercise caution during their visit.

22) Security staff may ask to look inside Ticketholders' bags. This is to ensure everyone’s safety. Please do not be offended. We ask for your cooperation in this regard.

23) In accordance with Smoke-Free Regulations, the Event is designated 'no smoking’. Normal statutory rules and regulations apply and should be observed at the Event. Failure to do so may result in the ejection of offending Ticketholders from the Venue.

24) The Organiser reserves the right to remove Ticketholders from the Venue or refuse entry for any reason including, but not limited to, behaviour that is; likely to cause damage, annoyance, or harm to others, health and safety reasons, if the Event staff believe that you are under the influence of drugs or alcohol, if you fail to produce proof of identity or age, or if you refuse to comply with the Organiser’s security searches. No refund of any monies paid will be offered in those circumstances. The Organiser’s decision as to what constitutes a breach/inappropriate behaviour will be final.

25) Please note that prolonged exposure to loud noise may cause damage to hearing.

26) Ticketholders undertake to comply with any and all instructions given to you by the Organiser and/or all Venue staff at the Event.

27) The following items are strictly prohibited and must not be taken by Ticketholders through the Event entry point: alcohol, drugs, sharp items, needles, knives, illegal substances, anything that could reasonably considered for use as a weapon, nitrous oxide and legal highs, food or drink (apart from soft drinks or water in plastic bottles), glass of any kind (including but not limited to perfume and cologne bottles, beer bottles, jars or drinking vessels), laser equipment and pens, megaphones, large sound systems, air horns, spray cans, fireworks, sparklers, flares, animals, unofficial tabards or hi-vis jackets, professional camera or video equipment, bicycles, scooters or vehicles. Other objects may not be permitted at the discretion of the Event team for safety reasons.

28). Alcohol cannot be brought into the Event site. It is illegal to attempt to buy alcohol if you are under 18, and it is illegal to purchase alcohol for another person who is under 18.

29) Strictly no animals are allowed into the event, with the exception of assistance dogs.

FILMING/PHOTOGRAPHY

30) By attending the Event, Purchasers and Ticketholders give their express consent to their actual or simulated likeness being included within any film, photograph, audio and/or audio-visual recording to be exploited in any and all media for any purpose at any time throughout the world, the copyright to which shall be owned by the Organiser or its contractors without payment or compensation.

This includes, but is not limited to:

·         Filming by Event staff or authorised third parties, for promotional and marketing use.

·         Filming by the police or security staff that may be carried out for the security of customers.

31) If a Ticketholder attends an Event with any child aged under 18 years, the Ticketholder gives the foregoing their express consent on the child's behalf.

REFUND POLICY

32) Tickets are NON-REFUNDABLE under any circumstances. The only exception to this is, in the unlikely event that the Organiser is required to cancel your session (for instance, due to extreme weather, logistics, or any other reason). In the unlikely event a timeslot is cancelled, this decision is made solely at the Organiser’s discretion. In those circumstances, the following process will take place.

Purchasers will be notified as soon as practically possible by the Organiser, via the booking email address given, with details of next steps. Following this, the Purchaser will contact the Organiser to arrange:

a) a transfer of their booking(s) to an alternative timeslot (at the equivalent financial value of their original booking, subject to availability),

b) or a refund, in the event that all remaining Event timeslots are not suitable.

Any such transfers/refunds must be requested by the Purchaser within 28 days of the date of the date you were booked to attend. The Organiser will not be liable for any other costs incurred by Purchasers or Ticketholders, including, but not limited to, travel, subsistence and/or accommodation.

33) Once bookings are made for the Event, they are valid for the Event starting time stated on the ticket. At the discretion of the Organiser, in certain circumstances, it may be possible to transfer booked ticket(s) to an alternative day.  Any transfer request must be made by the Purchaser at least 7 days before your original booked timeslot. If a preferred new timeslot is full, the Purchaser will need to either select an alternative timeslot or retain their original booking. Refunds are not available. Bookings are strictly non-transferable within 7 days or less of the Purchaser's booked date.

34) In the event that the Purchaser is entitled to a refund, they must refer to the terms and conditions for details of how to claim that refund. The Purchaser may not be entitled to obtain a refund if they fail to follow the instructions provided by the Event Organiser within the notified time frames. Refunds will only be made to the Purchaser who made the transaction, to the original payment method.

EVENT PROTOCOLS

35) Admission to the Winter Wonderland Walk is at all times subject to any terms, conditions or rules of Springfields Outlet. If Ticketholders breach those terms, conditions or rules, the Organiser may refuse admission or require you and/or other ticket holders to leave the venue.

36) Lost property will be collected during the event and held at the Information Point. When the event has concluded, any uncollected items will be disposed of within seven (7) days of the event. The Organiser accepts no responsibility for loss or damage of any kind suffered at or in connection with the Event to any property, including loss, damage, or theft of any personal property.

37) Ticketholders shall not be permitted to bring into the Venue or display or distribute (whether for free or not) at the Event any sponsorship, promotional or marketing materials.

EVENT CANCELLATION PROCEDURE

38) In rare circumstances, it may be necessary to cancel, change or postpone a night of the Walk. In such circumstances, the Purchaser will be contacted via the email address provided on booking (and via SMS message, if a valid mobile number was provided on booking). The Purchaser must regularly check their email (including Spam/Junk folders) for all such communications. The Organiser advises that the Purchaser and Ticketholders check the Organiser's website/social meida platforms prior to travelling to the Winter Wonderland Walk, as any changes/notifications may also be posted there.

39) It is the Purchaser's responsibility (on behalf of Ticketholders) to check that the Event has not been cancelled, rescheduled or made the subject of a material alteration. Information on such matters will be made available on behalf of the Organiser as soon as reasonably practicable on the Event website and/or at the Venue. Purchasers/Ticketholders are advised that the website cannot always be updated immediately and that circumstances giving rise to cancellation, postponement or material alterations can sometimes arise at late notice or immediately prior to an Event.

40) For the purposes of these terms and conditions, Force Majeure means any cause beyond the Organiser’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, medical emergencies, pandemics, acts of terrorism (or the threat thereof), fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather (including, but not limited to, high winds and/or excessive rain), third party injunction, national defence requirements and/or acts or regulations of national or local governments. The Organiser will not be liable to you for failure to perform any obligation under these terms and conditions to the extent that the failure is caused by Force Majeure.

41) In the event of a cancellation, postponement, or material alteration of the Event (defined below), you will be entitled to a refund in accordance with the terms and conditions or refund policy. Where the cancellation takes place part-way through an Event, at the discretion of the Organiser, the Purchaser may only be entitled to a partial refund of the face price ticket value. Personal arrangements, including travel, subsistence and accommodation in relation to the Event which have been arranged by you, are made at your own risk. Material alteration is a change which, in our reasonable opinion, makes the Event materially different to the Event which purchasers of the ticket could reasonably expect. Changes to performance times, features, acts and performers/participants shall not be considered a material alteration, and the Organiser will not be liable for such changes. A material alteration is judged by reference to the nature, form and billing of the Event. The Event is judged and valued by reference to the overall theme rather than any individual act, performer or participant scheduled to appear.

42) The Organiser will not have any liability to the Purchaser/Ticketholders whatsoever for loss or expenses incurred in connection with the Event or any cancellation of the Event, including, without limitation, costs of any personal travel, accommodation or hospitality arrangements made relating to the Event or the cancellation of the Event.

LEGAL

43) To the fullest extent permissible in law, the Organiser shall be entitled to assign all and any of its rights and obligations under these Terms and Conditions, provided that your rights are not adversely affected.

44) If any provision of the Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and the remainder of the Terms and Conditions valid or enforceable.

45) If the Organiser delays or fails to enforce any of the Terms and Conditions, it shall not mean that the Organiser has waived its right to do so.

46) Nothing in the Terms and Conditions and no action taken by the Purchaser/Ticketholders or the Organiser under the Terms and Conditions shall create, or be deemed to create, a partnership, joint venture, or establish a relationship of principal and agent or any other fiduciary relationship between you and the Organiser.

47) The Terms and Conditions constitute the entire agreement between the parties in connection with the subject matter of the Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between you and the Organiser relating to the subject matter of these terms and conditions.

48) Nothing in the Terms and Conditions shall purport to exclude liability for fraud or fraudulent misrepresentation.

49) The Terms and Conditions shall be governed by the laws of England and Wales, and all parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

50) Any person, other than the Organiser, who is not a party to the Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Terms and Conditions.

51) The Terms and Conditions are subject to change from time to time without notice and at our discretion. The Organiser will notify the Purchaser of amendments to the Terms and Conditions by posting them to this website (http://springfieldsoutlet.co.uk/events/).

52) To the extent permitted by law, personal information provided by you to the Organiser will be used for all purposes reasonably connected with the operations of the Event and the Organiser including (but not limited to): providing you with details of forthcoming connected events, offers and services; providing you with updates as to the latest concessions or any changes thereto and information concerning competitions and other promotional activity, supplying you with the goods that you request or in which the organiser reasonably believes you may be interested, conducting market research and establishing customer profiles, and transferring or disclosing the information provided to the Organiser’s professional advisors and such other parties as it considers necessary in the administration of its business. The organiser will not use or disclose your personal information other than as set out in these terms and conditions without your prior consent. You will be given the opportunity to unsubscribe from such marketing communications when you place your order and you can unsubscribe from any email communications you receive from the Organiser by following the unsubscribe link.

53) You agree that the Organiser shall not be liable to the Purchaser or Ticketholders for any indirect or consequential costs, claims, actual or alleged losses howsoever arising out of or in connection with the Event and/or our obligations hereunder including, but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation or loss of contract or other economic or consequential loss arising from the performance (or any failure to perform) these Terms and Conditions.

54) Neither the Venue nor the Organiser shall have any further liability beyond the face value of the ticket purchased plus the relevant per-ticket booking fee.

55) The Organiser shall not be liable for the acts or omissions of the operators of the Venues, for any personal injury suffered at the Venue (unless due to the act or omissions of the Organiser) or any loss, theft or damage to your property including but not limited to clothes at the Venue (unless due to the act or omissions of the Organiser).

COMPLAINTS PROCEDURE

56) You agree that the Organiser, its servants or agents will not be liable for any loss, injury or damage to any person (including yourself) or property however caused (including by the Organiser or its servants or agents): (a) in any circumstances where there is no breach of a legal duty of care owed by the Organiser or any of its servants or agents; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury as a result of a breach of a legal duty of care owed by the Organiser, its servants or agents); and/or (c) to the extent that any increase in any loss or damage results from the breach by you of any of these Terms and Conditions.

57) In the event that you believe you have a legitimate complaint that may give rise to a claim against the Organiser, you are required to notify the Organiser in writing of such complaint within twenty-eight (28) calendar days of the Event. If so notified, the Organiser undertakes to investigate and consider the nature and cause of the complaint.
